A model demonstrates the researcher’s interpretation of how concepts are related to one another and are developed based on qualitative research. Models often are precursors to theory development.

Case brief-1.1, legal, ethical and judicial environment

The below case is based on Chapter-1 Case 1.1, please see attached textbook.

                                                      Yates v. U.S.

                                              135 S.Ct. 1074 (2015)

FACTS:  John Yates, a commercial fisherman, caught undersized red grouper in federal waters in the Gulf of Mexico. To prevent federal authorities from confirming that he had harvested undersized fish, Yates ordered a crew member to toss the suspect fish into the sea. Yates was charged with obstruction of justice through destruction of the small red grouper fish.

DECISIONS BELOW: Yates was convicted and appealed. His conviction was upheld.  He appealed to the U.S. Supreme Court.

ISSUE ON APPEAL: Is the release of fish back into the sea obstruction of justice?

DECISION: A split court held that the fish were not “tangible objects” for purposes of the obstruction of justice statute.  The court held that the statute was passed to cover files and electronic records and not tangible objects such as fish. The court held that the statute was passed in the wake of financial and ethical collapses in companies and was not intended to have generic application. It was directed at electronic files and documentation, not tangible objects such as fish.

Using information from this week’s readings and academic sources, answer the following questions in 500 words (minimum):

  1. Explain what Mr. Yates did and why.
  2. Describe the terms used in the statute at issue and the history of the statute.
  3. Why does the dissent think the majority made the decision it did?

  1. Do you consider erosion as a constructive force, destructive force, both, or neither? Please explain.
  2. Do you believe that man should intervene in areas that are being effected by erosion? In your response please consider the idea that erosion is a natural process.

I consider erosion to be both destructive and constructive. Here are the reasons for that.

I think that erosion is destructive since it can break down and destroy landforms. Water, ice, wind and gravity can all cause destructive erosion as they move sediment from one place to another. Land erosion can make some slopes become unstable and lead to landslides. Wind erosion can be very destructive as well. The North American “Dust Bowl” of the 1930s is a good example of that. There, strong winds eroded most of valuable topsoil and devastated local economies. As a result, thousands of people whose lives were dependent on agriculture were forced to leave the area. Water can cause erosions of valleys as rushing streams and rivers wear away their banks. In addition, during coastal erosion, people can lose their homes and businesses.

On the other hand, erosion can be constructive. It can help in formation of new landforms as sediment gets deposited after being carried from one place to another. Sandbars and river deltas are good examples of that. In addition, as the wind moves topsoil from one place to another, it can help construct good soil in an area that needs it.

I think that people should intervene in areas that are being affected by erosion if it becomes a danger to human life. For instance, if there is a possibility of erosion of coastal homes and/or businesses, people should intervene by helping with evacuation efforts. They can also help to rebuild and/or fix what has been damaged or destroyed due to erosion.

From the reading, I know erosion is the the process by which the surface of the earth is worn away by the action of water, glaciers, winds, and waves. Destructive erosion is where you take part of one land from away to create a new one. It sounds erosion is a destructive force. If we look at the example of water erosion, the water flow take part of water bed away to create a flat one at the end of rivers. Also there is a v-shaped valley to u-shaped valley. This u-shaped valley use to be a v-shaped valley until ice eroded it away. The ice cuts into the rock and curves it out to form a u-shaped valley.

I don’t think that man should intervene in areas that are being effected by erosion because the erosion is a nature process. The areas effected by erosion will be changed day by day. This areas will eventually have the cliff falls down. No matter what man do for these area, man can’t beat the power of nature. We see a lot of examples form the videos. If you built houses around the erosion areas, once there is heavily rain, the water flow will cause more, severe and quick erosion. Even man build dams to protect their house, the dams will collapse. The only thing man can do is running away from these areas.

Man can not change nature features, but we can change the way we live on this earth. The most important thing man should do is to protect the earth. We should do recycle and reuse items for our daily life. in this way, the energy flow in our earth will be less dramatic. The erosion from water, glaciers, winds, and waves will be slower.

Discuss The Role Of Advanced Practice Nursing In Safe Prescribing And 3 Prescribing Barriers For APRNs.

You now have an idea of the role of the APRN, and legal/professional issues in prescribing. As a future nurse practitioner, you have the authority, based on your state nurse practice act, to prescribe medications for the patients for whom you will provide care, and the responsibility of prescriptive authority is more than just simply writing a prescription correctly.

COLLEGE ADMISSIONS FOR MINORITIES – My Nursing Experts

The civil rights movement and Presidents John F. Kennedy and Lyndon B. Johnson’s War on Poverty in the mid-1960’s launched a movement for the nation to respond by offering equal access to education, housing, and other resources (Alger et al., 2000).  In June 1965, President Johnson spoke at Howard University outlining the major principles behind affirmative action.  He stated:
“You do not take a man who for years has been hobbled by chains, liberate him, bring him to the starting line of a race, saying, ‘you are free to compete with all the others’, and still justly believe you have been completely fair…This is the next and more profound stage of the battle for civil rights.  We seek not just freedom but opportunity-not legal equity but human ability-not just equality as a right and a theory, but equality as a fact and as a result” (ECS, 1).
President Johnson reinforced his speech by signing an Executive Order in late 1965 mandating government contractors to “take affirmative action” in all aspects of hiring and employing minorities (Brunner, 2002).  Six years later the order was amended to prohibit discrimination on the basis of sex.
As a result of this mandate, many colleges and professional schools started to recruit minority students as a part of their educational mission.  Ultimately, this led to these institutions initiating admission policies that took race into consideration.  These policies increased admission for African Americans and Hispanics at predominately white institutions.
Regents of the University of California v. Bakke (1978) was the first case to question the legality of affirmative action policies in higher education.  Allan Bakke, a white applicant, claimed he was wrongfully denied admission to medical school at the University of California to make room for less qualified minority applicants.  The US Supreme Court ruled that the establishment or use of “racial quotas” in determining admission violates the Equal Protection Clause of the Fourteenth Amendment; however, institutions of higher learning can still consider race as one factor, among many, in the admission process.
Over the next 25 years, affirmative action policies in higher education sparked many debates and issues.  Most recently, the Supreme Court ruled on the monumental decision in Grutter v. Bollinger (2003) which allowed the University of Michigan Law School to use race-based affirmative action to diversify its student body.  However, in the Gratz v. Rggewis (2003) decision, the Supreme Court ruled that the university’s undergraduate College of Literature, Science, and Arts could not use an admission process that awarded points based on an applicant’s race and ethnicity.  The decisions by the Supreme Court have now changed the future of affirmative action in the undergraduate admission process, given that race and ethnicity cannot be awarded “extra” points to help admit certain applicants.
So now I ask you, should minorities have lower admission standards in order to racially balance college populations?  Should race and ethnic background be a consideration at all in the college admission process, or does that promote reverse discrimination?  Consider the many different races affected by this.
